How it relates to Racine County

In the 1961 paradoxical novel CATCH-22, Joseph Heller created an unending circular reasoning between sanity and insanity. Heller created a dilemma of difficult circumstances from which there is no escape because of mutually conflicting or dependant conditions.

In the novel, you were place in the dilemma of 
"damned if you do and damned if you don't"
 henceforth the term "CATCH-22" came into play in the english language.

You may be asking yourself how does Joseph Heller's book apply to our U. S. Constitution? 

A recent Racine County Circuit Court case brought  
CATCH-22 to mind.
  
As an avid reader and constitutionalist, I often think about how thought provoking literature can correlate to law.

As a constitutionalist, I have long held that "the citizen should not have to relinquish a right to preserve another right". 
To do so is a "Catch-22".  It is the simplest of litmus tests I use to determine whether a law can pass the muster of the U.S. constitution. Of course there are other considerations as to the constitutionality of law, but the "Catch-22" analysis keeps it clean, simple and free of circular reasoning and acts.

CASE IN POINT
Milewski  vs. Town of Dover 
Racine County Circuit Court Case # 14CV1482

The Milewski's were placed into a CATCH-22 when a law relinquished one right to protect another.

SHORTENED VERSION
Case 14CV1484 well illuminates the paradox of written tax law of how a law can be "illegal".

The ill advised notion "it is law therefore it is legal" was used by the Town of Dover to assess Vincent Milewski and Morgane McDonald's (husband/wife) property. 

In 2013, an employee of Gardiner Appraisal Services, acting on behalf of the Town of Dover requested entry into the Milewski household in order to assess the property value of their residence.
Vincent and Morgane politely refused the tax assessor entry into their home asserting their 4th. Amendment right to be free from searches.

Do to the Milewski's refusing the assessor entry in their home, Gardiner arbitrarily raised the Mill rate to Milewski's property and the Town Board applied such assessment.

That may not had been a problem at the time had the Town of Dover Review Board allowed the Milewski's the right to due process to contest the increased Mill rate.

 Instead the Town of Dover Board of Review refused the Milewski's the right to due process, citing law as their reasoning.

Here was the CATCH-22 of the law ;
The law prevented homeowners who exercised their 4th. amendment rights to assert their 14th. amendment rights. 

Specifically, the then active law required owners of property to consent to a tax assessor entering your home or lose your due process rights in front of Boards of Review, Department of Revenue and even the courts.


In 2017, the Wisconsin Supreme Court declared the law unconstitutional, overruling the law in their 47 page opinion.  The Wisconsin Supreme Court basically stated you cannot be denied a right because you invoked another right.

The Wisconsin Supreme Court got this one right!!!

Weidner Found Guilty of Contempt of Court
and
RCC finds the court in contempt of the public

Judge Gagthebitch during his final comments of today's court hearing called Weidner's case "the most egregious" example of contempt of court he's seen by a lawmaker. 

Gagthebitch further stated during the hearing;

"It is pure anarchy if people do not obey a court order," "That is the heart-blood of an orderly society."

In an honest court, all that the judge stated above would be accurate .

But Judge Gasiorkiewicz's court is not an honorable court.

If one blindly obeys an order of a corrupt and secret court
 then we may have tyranny

Think about this folks, it is the  
 irony and hypocrisy of an open records request morphing into a sealed court case that is strikingly counterintuitive to the very heart and soul of Wisconsin Public Record laws.

The preponderance of evidence of the Sept.25th sealed court hearing exposes the judge as a manipulative double talking scoundrel that begs for a forensic audit of this court case. 

Court transcripts along with supporting documents of the Sept.25th hearing posted in our Sept. 27th blog illuminates Judge Gagthebitch actively conspiring to deny Ms. Weidner the right of the public to attend the 
scheduled UNPOSTED hearing. 

The court's egregious conduct has knowingly put Ms. Weidner in a Catch 22 situation.  A situation of irrational circular reasoning to which there is no way out of the judges trap.  

The Catch 22
By violating the gag order, Ms Weidner allows the public to scrutinize the court, but doing so puts her in harm's way of contempt of court.  If she complies with the gag order she remains in a secret court subject 
to the wrath of tyranny.
Asserting her First amendment rights will benefit an informed public but in doing so risk additional fines and damage claims the court may assess.

There exist no rational reasoning to escape the circular conundrum.

This is an open records case.
 Only a complete fool or complicit judge would put a litigant into this position.  

. The judge has not only violated Ms. Weidner, the judge has conspired to violate every Wisconsin citizens rights to access public records and to court proceedings. 

Tyranny begins in secret courts, quashing one opponent at a time without the knowledge and scrutiny of the general public.
Secret courts are a cornerstone of tyranny.

Any sealed court case should be highly questioned and challenged by the general public. To leave your fellow citizen go it alone in a secret court is desertion of morals and ideals, thus creating ideal circumstances for evil to flourish.


This court plays very dirty.
Judge Gasiorkiewicz was put on notice before the Oct 3rd. hearing that he was derelict of his judicial responsibilities by failing to post public notice of the hearing. We at RCC assert the court knowingly failed to post notice of today's hearing and the Sept. 25th hearing.  Judge Gasiorkiewicz conspired and knowingly subverted Wisconsin laws to act against the rights of citizens. These judicial errors, acts and omissions are contrary to Wisconsin statutes and the Wisconsin constitution, in doing so the judge has violated his oath of office.

During the court hearing, Judge Gasiorkiewicz used prima facie evidence to hold Sandy Weidner in contempt of court. 

Holding Judge Gasiorkiewicz to the same prima facie standard, Judge Gasiorkiewicz is guilty of conspiring and acting to subvert Wisconsin statutes, the Wisconsin constitution and 
First Amendment rights. 

RCC calls for the resignation or removal of Judge Gasiorkiewicz for blatant errors, acts and omissions of his judicial duties.

DOVER DRAMA

In the quaint Kingdom of Dover Wi.

 

Drama kings and queens are at it again. 

The kingdom of Dover has lots of legally aged adults who for unknown reasons haven't mentally matured.  Overactive and hypersensitive temperaments flare like fifth graders warring over nerf balls.  Every few years the drama kings and queens have to act up and engage in WoW (Wars of Words). 

   One stupid says something

Another stupid does something

That is how it often works.

Just like Super Mario Brothers!

One election working with each other,  next election knocking each other out of the game.

The pettiness of politics transcends geopolitical boundaries to the Union Grove area as well, where children are indoctrinated into believing that government is only good and without fault. Where the only lessons the school teaches are OBEY! OBEY!! OBEY!!!
Act up and you are facing the Racine County Sheriff Department, followed by jail.
A school system where math,science and geography are no longer important. But they will teach the kids how be be properly indoctrinated, follow orders and accept authority and rule.
OBEY! OBEY!! OBEY!!!

A taste of political reality is just what children are in need of. 
Mandatory reading is no longer part of the school curriculum.
Reading "The Good Earth", "1984", and "Catch 22" will not be part of an indoctrinated student.

And what about our worthless press?
The local Racine Journal Times has yet to take on head to head the Foxconn eminent domain fiasco that is currently in full swing. 
We have government officials who are violating their oath of office as they misuse eminent domain proceedings against landowners to acquire land for a foreign corporation.
Government corruption is real and prevalent, so the more we speak and act about it, the better we can address it.  

But back to the fine town of Dover:
We all know current chairman Mario Lena was not elected to be a Politician or Statesman. nor does he pretend to be.
Truth being known, I'm not sure he is smarter than a box of rocks.
Even a box of rocks knows when to remain silent and when to make noise.

Mario campaigned on the promise that town of Dover funds would be better allocated back to serve the residents of Dover, not to fund parasitic engineering and law firms who siphons funds from road and public utility projects. 

Lena's plan must be working, at the last town hall meeting, road repair crews stated a records amount of material was used to repair town roads ( or did he say historical) matters not.

 To see childish behavior makes me wonder what event stymied so many adults from mentality maturing.

  These adults appear educated, but failed to learn how to prioritize life's twists and turns.  Perhaps some of the pettiness, hypersensitivity and childish behavior may be attributed to petty conversations, jealousy, dementia or alzheimer's.

  For years field and yard runoff have spoiled the water quality of Eagle lake. Add DNR administered poisons to the lake and

declared dead several times. 
Must make people brain dead when they drink the water!

Judge Repischak doesn’t appear at hearing

and I’m wearing the bling

Racine County Circuit Case # 22CF1223

 

Judge Repischak didn’t appear at his court scheduled hearing on 8-16-2024 at 1:30 pm.   Emails between the court and defendant confirm the court date was etched in stone.

Judge Repischak took the cowardly way out knowingly I was prepared to metaphorically rip his face off during the August 16^th, 2024 hearing. Know this, I don’t fear Judge Repischak, I loathe him.

Judge Repischak failed to notify the defendant that court was cancelled, but he took the time to remove the August 16^th date from WCCA records, placing me in a catch 22.  There is no obligation for a litigant to follow WCCA online records. Without a notice of cancellation or change of dates from the court, I am required to attend the scheduled court event.  But in the interest of my supporters, I notified the public the court had taken the case off of it’s calendar.

 

The showdown was imminent, Defendant appeared at court for his scheduled hearing only to find the courtroom lights were off and the courtroom door was lock.  Should you decide to investigate my claims, just look into the WCCA court record and try to find a cancellation notice for the August 16^th hearing within the court files, there isn’t any. 

Court was being held next door, so 4 court observers & I attended Judge Fredrickson’s (the only judge I trust) hearing long enough to hear the court case being called to order.   After hearing the case # being called, we left the courtroom and proceeded down the hallway, up the stairs to exit the building.  That’s when I was detained, refinger printed, remugshot, for not appearing at an impromptu scheduled August 1^st hearing which I notified the court I would not be attending and further notified the court I would be attending the August 16^th hearing date. I am now wearing an ankle bracelet installed for my next Friday 23^rd hearing in Elkhorn.  

Judge Repischak joins the infamous list of disingenuous judges in Racine County who think they are Gods, not subject to the scrutiny of the public. Repischak joins the family of corrupt judges, such as legal whores Kristen Cafferty and Faye Flancher who allowed shyster attorney Thomas Camilli, then a partner in the law firm of Godin, Geraghty, Puntillo, Camilli & Hughes to file a contested false affidavit into the court record (Racine County case # 20PR15, court document # 37)with impunity.   Let us not forget to mention the King of corruption, Judge Eugene Gagthebitch himself, who conducted illegal secret court in the case of Sandy Weidner vs. City of Racine.

(Racine County Circuit Court case # 17CV1644). 

A case where an open records request turned into a secret court, where the court docketing # & dates of the hearings, and the litigants names were not published on WCCA online records. Sandy Weidner was being set up in Gagthebitch’s court. Judge Gagthebitch was protecting Mayor Cory Mason & City attorney Scott Letteney conducting illegal acts.

A MOTION TO INTERVENE had to be filed to open the court record to public scrutiny, to protect litigant Sandy Weidner from the evil and corrupt pay to play Racine County Circuit Court system. Judge Gasiorkiewicz committed crimes conducting the secret court, but he was never brought to justice.   Judge Gagthebitch will live with his corrupt ways for infamy, or as Judge Gagthebitch complains "ad nauseam".

 

The ankle bracelet is a great conversational piece, the bracelet opens conversations to further expose the corruption of the Racine County Circus Court.  It’s like wearing a badge of honor.

How ironic is this?
Case # 18AP1189 involves a Wisconsin Public Records Request(open records),  yet the complete court record is sealed contrary to law.

Citizens have rights to know the court docketing # , the names of the parties, the court schedule and to attend hearings. The U.S. Supreme court says so and so does Wisconsin statutes.

Judge Lisa Neubauer is a scofflaw, violates your state and federal rights with impunity simply because she can.

The Wisconsin Judicial Commission and the Wisconsin Attorney General will do nothing to correct her egregious conduct as she violates citizen rights.

.The Wisconsin Judicial Commission is nothing more than a bad joke upon the public as is the Office of Lawyer Regulation and the Wisconsin Attorney General's office.

Conducting court in secrecy is unconstitutional and further violates Wisconsin statutes 757.14 and  59.20(3),  the first Amendment of the U.S. Constitution and Wisconsin Supreme Court Rules (SCR).

 Wisconsin Statute 757.14   “The sittings of every court shall be public and every citizen may freely attend the same……” 

Citizens are directly empowered by statute 757.14 to observe court proceedings.

Wisconsin Statute 59.20(3), The court shall:
" open to the examination of any person all books and papers required to be kept in his or her office and permit any person so examining to take notes and copies of such books, records, papers or minutes ...."

Citizens are directly empowered by statute 59.20(3) to the opening of the Circuit Court record to public examination.

Supreme Court Rules - 60 Preamble. Our legal system is based on the principle that an independent, fair and competent judiciary will interpret and apply the laws that govern us. The role of the judiciary is central to American concepts of justice and the rule of law. Intrinsic to all provisions of this Code are the precepts that judges, individually and collectively, must respect and honor the judicial office as a public trust and strive to enhance and maintain confidence in our legal system. The judge is an arbiter of facts and law for the resolution of disputes and a highly visible symbol of government under the rule of law.

SCR 60.02   A judge shall uphold the integrity and independence

 of the judiciary.

SCR 60.03   A judge shall avoid impropriety and the appearance

 of impropriety in all of the judge's activities.

SCR 60.04   A judge shall perform the duties of judicial office

 impartially and diligently.

The First Amendment of the

U. S. constitution guarantees that American court proceedings are presumptively open to the public. The U.S. Supreme court has explained the public's presumptive right of access to court proceedings are rooted in both logic and history

Citizens only recourse to right these wrongs is to expose, embarass, humiliate and degrade

There was no legal basis to seal the entire court record, yet Judge Gasiorkiewicz and Judge Neubauer did so.

City of Racine Alderman Sandy Weidner in her open records court case endured the darkness of secret courts for 7 months before being freed by citizens and the collective news media.

The insanity and facts continue.

 5.8 million Wisconsin Citizen's rights are currently being violated every day in a current secret court case,  overseen by a current judicial candidate for the Wisconsin Supreme Court who claims she rules on law.

Bazarre?  Yes !

Judge Lisa Neubauer is currently conducting illegal court in violation of the law, currently violating your rights and she is asking you to trust her judgement to be your next Supreme Court Justice.   WTF?

Is it a coincidence, or is it conspiracy, complicity and collusion that Judge Eugene Gasiorkiewicz of the lower Circuit Court and Judge Lisa Neubauer of the Court of Appeals conducts 
illegal SECRET court proceedings and violates 
the exact same statutes and rules in the same case?
